The general terms and conditions of the Soca Fly.si online store have been compiled in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).
The Soca Fly online store (hereinafter also referred to as the “store”) is operated by Soca Fly s.p., registration number: 0000000 , tax number: 0000000 , which is also an e-commerce service provider (hereinafter also the seller or Soca Fly).
The General Terms and Conditions determine the operation of the Soca Fly online store, the rights and obligations of the user and the store, and regulate the business relationship between Soca Fly and the customer. The General Terms and Conditions also regulate individual purchase rules at the collection points of the company Soca Fly s.p.
The buyer is bound by the general conditions that are valid at the time of purchase (placing an online order). When placing an order, the user is reminded of the general terms and conditions of business and confirms his / her acquaintance with them by placing an order. The General Terms and Conditions are also available for inspection at the Soca Fly shop Most na Soci collection point.
Order
The purchase contract between Soca Fly and the customer is concluded in the Soca Fly online store at the moment when Soca Fly sends the customer the first electronic message about the status of his order. From this moment on, all prices and other conditions are fixed and apply to both Soca Fly and the customer. The buyer is a person with the information as stated when placing the order. It is not possible to change customer data later.
The sales contract (i.e. the first electronic order status message) is stored electronically on the Soca Fly server.
Methods of payment
The Soca Fly website provides the following payment methods:
- By transfer to the bank account of Soca Fly s.p. according to the offer / proforma invoice
- Through the payment service provider PayPal Ltd.
Issuance of the invoice
Soca Fly s.p., also sends an invoice to the customer upon delivery of the ordered items in a physical form together with the order delivery. The customer receives an invoice for each separate order or a separate shipment within the order separately.
The invoice breaks down the price and all costs related to the purchase.
The buyer is obliged to check the correctness of the data before placing the order. Subsequent objections regarding the correctness of the issued invoices are not taken into account.
Purchase notification process
1st order
After placing the order, the buyer receives a notification by e-mail that the order has been accepted. Soca Fly may call the customer on his contact telephone number to verify the information or to ensure the accuracy of the delivery.
- The order has been shipped.
Soca Fly prepares and sends items as soon as possible (1-3 days from order confirmation). In the event that the buyer decides to cancel the order in a timely manner, the seller must immediatelybe notified on the telephone number + 386 031 705 552 or by e-mail to socafly@gmail.com. If it happens that the order has already been shipped, the buyer rejects the shipment to the delivery service.
The right of withdrawal of the consumer from the contract
The consumer has the right to notify the seller within 14 days of receipt of the item that he withdraws from the contract without having to state the reason for his decision. The deadline starts one day after the date of receipt of the items.
Withdrawal from the contract is notified by the consumer to the seller’s e-mail address: socafly@gmail.com.
In case of withdrawal from the contract, the consumer returns the received item by mail to the address Soca Fly, Most na Soči 62, 5216 – Most na Soči or brings it to this same address in person during the working hours of the store.
The return of the received items to the company within the deadline for withdrawal from the contract and a short written confirmation of the return by the buyer is considered a notice of withdrawal from the contract.
The consumer must return the item to the seller undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has decreased without the consumer being at fault. The consumer may not use the items without hindrance until the withdrawal from the contract. The consumer is liable for a reduction in the value of the goods if the reduction is the result of conduct not necessarily necessary to establish the nature, characteristics and functioning of the goods.
The only cost borne by the consumer in connection with the withdrawal from the contract is the cost of returning the items (which in the case of shipping is charged according to the price list of the delivery service and depends on whether it is a shipment / package / cargo). The item must be returned to the seller no later than 10 days after the notification of withdrawal from the contract (purchase).
The consumer does not have the right to withdraw from the contract in the case of contracts the subject of which is an article which has been manufactured according to the precise instructions of the consumer, adapted to his personal needs, which by its nature is not suitable for return.
Withdrawal from the contract is not possible for goods:
- For goods made according to the consumer’s precise instructions and adapted to his personal needs;
Reimbursement of payments made, including delivery costs (except for additional costs due to the choice of delivery type, which is not the most affordable standard form of delivery offered by the company) will be made as soon as possible, but no later than 14 days after receipt of notice of withdrawal . The company returns the received payments to the consumer by payment to the transaction account), unless the consumer has explicitly requested the use of a different means of payment and if the consumer does not bear any costs as a result.
The right to a refund of the purchase price in the event of a warranty claim and material defects is regulated in more detail by the provisions of the Consumer Protection Act.
Warranty
Items have a warranty if stated on the warranty card or invoice. The warranty is valid subject to the instructions on the warranty card and upon submission of the invoice. Warranty periods are stated on the warranty sheets or on the invoice. Warranty information is also listed on the product presentation page. If there is no warranty information, the item does not have a warranty or the information is not known at this time. In the latter case, the customer can contact Soca Fly, which will provide up-to-date information.
Delivery
Our contractual partner for the delivery of shipments in the territory of Slovenia is Pošta Slovenije d.d., which will deliver the ordered goods to the buyer within the stipulated period of 1-3 working days from the day of the confirmed order. Soca Fly reserves the right to choose another delivery service if it will be able to fulfill the order more efficiently. Also, Soca Fly does not take responsibility if the selected delivery service is unable to deliver the goods within the period specified in this article due to force majeure. The price of standard delivery (home in 3-7 days) is € 6,90. The price includes VAT.
Protection of personal data
Soca Fly is committed to the permanent protection of all personal data of the user in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and the CSDP
The user must be aware that he is obliged to provide the personal trader with his personal data in the correct and true form, and he is also obliged to inform the online trader about the change of his data. By accepting these conditions, the user confirms that the personal data provided by him are correct.
